Introduction

Afart Creations stands for African Art Creations; it is a digital monetization platform that seeks to monetize artistic creations virtually ranging from audio recordings, audio-visual recordings, live concerts and merchandise. Afart Creations trades under Yoyo Productions Limited, a company duly incorporated and licenced under the laws of Uganda, hereinafter referred to as the “company”. These terms and conditions shall be valid for all accounts activity conducted on the Afart Creations web app. Please read these terms and conditions carefully before opening up an account on afartcreations.com. Terminology

‘He’ means both genders. ‘Company’, ‘we’ and ‘our’ means the Company. ‘Client’, ‘User’, ‘you’ or ‘your’ means a person with a an account. ‘Website’ or ‘site’ means the Company.ug ‘Terms’ means these Terms & Conditions

Amendments to the Terms

The Terms can be changed at any time by the Company at its own discretion. All changes will become effective upon their publication on the site. In case of substantial amendment to the Terms, the Company will give notice to Clients prior to such amendment taking effect. For minor or insubstantial amendments to the Terms the Company may not send notification.

Applicable Law

All agreements and contracts, as well as any other legal relationship between the Client and the Company, for every circumstance not regulated by these Terms, is subject to Ugandan law. The Courts of Uganda are agreed as the ultimate place of jurisdiction in the event of any dispute arising between the Client and the Company.

Creating accounts

In order to interact or transact anything with company, the client has to make account on the site. There are two types of accounts i.e. the buyer’s account and the creator’s account.

Buyers account

A buyer’s account is an account that any individual can make for as long as he has a valid phone number or a valid email for some cases and a password. Your phone number or email and password are for your personal use only and should be kept confidential. This account grants access to all content ready for purchase, however this account grants no right that enable the client to upload content to the site.

Creators account.

A creator’s account grants the client the right to upload content to the site. This account however will require the client to first have a buyer’s account and will also require extra verification from the company.

Brand accounts

If a client establishes an afartcreations account on behalf of a company, organisation, entity or brand (a “Brand”, and such account a “Brand account”), the client shall have to confirm to us that he has authority to act on behalf of that entity, and that that entity accepts the Agreement.

Verification of a creator’s account.

All rights to verify a creator’s account will be held by the company and each submission by client to have he’s account verified will be handled on an individual basis.

Uploading of content

"Content" includes all information, materials and other content that is added, created, uploaded, submitted, distributed, or posted to the site. The company reserves the right to remove or disable access to any content that violates our company terms. Afartcretions may take these actions without prior notification to you. All content uploaded to the site will be subject to seven (7) working days of scrutiny before being made available to the public. However, in order for us to make your Content available on the site, we do need a limited license from you to that Content. Accordingly, you hereby grant to company a non-exclusive, transferable, sub-licensable, royalty-free, fully paid, irrevocable, worldwide license to reproduce, make available, perform and display, translate, modify, create derivative works from, distribute, and otherwise use any such Content through any medium, whether alone or in combination with other Content or materials, in any manner and by any means, method or technology, whether now known or hereafter created, in connection with the company. Where applicable and to the extent permitted under applicable law, you also agree to waive, and not to enforce, any "moral rights" or equivalent rights, such as your right to be identified as the author of any User Content, including Feedback, and your right to object to derogatory treatment of such Content. The site does not allow pornographic content and politically divisive content

Disputes

Any dispute should immediately be reported to the company by email or telephone and the company shall use its best efforts to resolve any dispute with Clients.

refunds

All money deposited on the platform will not be refunded. In the event of a legitimate claim, the account will be credited

Legality of Site Use

Use of the site may be illegal in certain countries therefore every Client is responsible for determining whether use of the site is compliant with applicable laws in the jurisdiction in which he is located at the time of usage. The Company site does not constitute an offer, solicitation or invitation by the Company for the use it’s services in any countries where such activity is or may be illegal.

Liabilities & Warranties

The Company does not warrant the constant availability and functionality of services and may not be held liable by the Client for any damages, losses, costs, loss of profits or any other disadvantage a Client may incur in connection with any disconnection from or the non-availability of any of the services offered by the Company. the Company cannot be held liable in any case for any damage or loss caused directly or indirectly by the site, its contents or content provided by a third party. The Company is not liable for any failures caused by the electronic equipment used by the Client while accessing the site or for faults due to the internet service provider used by the Client while accessing the website. The Company assumes no liability for correctness, completeness or up-to-dateness of the information services provided on its website.
